This is an application under Section 439 of the Code of Criminal Procedure for bail in CR No.275/2018 registered with Dattawadi Police Station, Pune under Sections 3,4 and 5 of the Prevention of Immoral Traffic Act and under Section 370(2) and (3) read with 34 of the Indian Penal Code.

Heard the learned counsel for the applicant and the learned APP. Perused the charge-sheet.

The prosecution case in brief is that, the applicant is the owner of Lemon Aqua Spa and Saloon situated near Surakshanagr Society, Pune. In the said premises, the vocation of prostitution was conducted by the applicant in connivance with co-accused Sunil Rathod who was working as Manager of the said Spa. After receipt of information, the police sent decoy customer and after verification, a raid was conducted. The accused Sunil Rathod was found at the spot. During the enquiry, it revealed that, the applicant is the owner of the said Spa wherein the said vocation was conducted.

The record of investigation indicates that, the victim ladies found at the scene of offence are major and in their statements they stated that, they were employed in the said Spa. It appears that, the victim ladies who were allegedly indulging into vocation of prostitution were doing so at their own will.

The applicant is in Jail since 20.7.2018 and after completion of investigation the police have submitted chargesheet. No purpose will be served by further keeping the applicant in incarceration. 6.

Hence, the following order.

a) The applicant be released on bail in CR No.275/2018 registered with Dattawadi Police Station, Pune on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount. b) The applicant shall attend the Investigating officer on every first Monday of the month between 10.00a.m.to 1.00p.m. till the conclusion of trial.

c) The applicant shall attend all the dates before the Trial Court unless precluded on medical ground.

d) Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
