Heard learned counsel for the applicants and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 170, 506 and 507 of the Indian Penal Code, 1860 in connection with C.R. No.801 of 2022 dated 27/04/2022 registered with Dahisar Police Station.

In the FIR it is alleged that on 15/04/2022 at around 13.29 hours the applicant No.1 had allegedly telephonically

called the complainant pretending that the call is from Andheri Police Station. The complainant was threatened that she should settle the matter. The complainant responded by saying that she will inform the concerned Police Station and disconnected the telephone. Thereafter, it was revealed that the call was made by the applicant No.1. It appears that the applicants had attended nail arts classes conducted by the complainant on some previous occasions. Even the applicants were running the nail arts business. The applicant No.1 was since arrested and has been released on bail. It is the applicant No.1 who had made the phone call. 4.

Having regard to the nature of the allegations, in my opinion, the custodial interrogation of the applicant No.2 is not required in the present case.

Learned counsel for the applicant No.2 submits that she is willing to co-operate. Hence, the following order :-

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.801 of 2022 registered with Dahisar Police Station, the applicant No.2-Payal Shiv Kumar Singh shall be released on bail on furnishing P.R. Bond to the extent

of Rs.25,000/- with one or more sureties in the like amount.

(c) The applicant No.2 shall report to the concerned police station on 26/12/2022 between 10.00 and 12.00 p.m.

(d) The applicant No.2 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Ofcer and shall not tamper with evidence. (e) The applicant No.2 shall furnish the details of her residential address and phone numbers to the investigating officer.
