This is the second anticipatory bail application by the applicant. The earlier bail application preferred by the applicant in the present crime i.e. CR No.89/2015 registered with Aary Police Station, Goregaon, Mumbai was dismissed as withdrawn by an order dated 18.12.2015.The present application was moved before the Vacation Court on 1.1.2016 when the learned Judge of the Vacation Court was pleased to remove the matter from the board observing "No order". Thereafter, on 13.1.2016, 27.1.2016 and 10.2.2016 the learned counsel for the applicant sought adjournments on some or other pretext. Today also the learned counsel holding for Advocate on record sought an adjournment on the ground that the Advocate on record is in some difficulty. Mr.

Upadhyay learned counsel appearing for the original complainant vehemently opposed the said request and submitted that after rejection of the first application the applicant herein instead of surrendering himself before the Investigating officer as was stated in order dated on 18.12.2015, is absconding . In view of the above, it appears that the applicant is not interested in pursuing the present application.

The present application is accordingly dismissed for the aforesaid reasons.
