The Petitioner challenges the genuineness of the Will. The Police Inspector of Sion Police Station issued communication dated 24th June, 2015 Exh. 'C', wherein it is mentioned that the Probate Petition No. 2013 of 2014 is pending in the Bombay High Court.

In this view of the matter, no interference is warranted at this stage in exercise of our extraordinary writ jurisdiction. However, the petitioner may resort to alternate statutory remedy, as permissible under the Criminal Procedure Code.
