All these applicants are seeking pre-arrest bail in Crime No. I138 of 2018 registered with Mharsul Police Station, Nashik for
2 913.2415.18 aba.doc offence punishable under sections 384, 504, 506 r/w 34 of the Indian Penal Code.
Applicant in Application No. 2543/2018 is a lawyer by profession and is representing the interest of applicant in other application in the said matrimonial proceedings. There appears to be a matrimonial discord between the complainant and the applicants in Application No. 2415/2018. An Ex-parte Decree for divorce passed against the complainant appears to be a bone of contents in lodging the crime in question wherein the allegations of extortion are made.
In the aforesaid background, in my opinion, false implication cannot be ruled out. In view thereof, custodial interrogation of applicants is not warranted. Hence, following order: (A) In the event of arrest of the applicant in Crime No. I138 of 2018 registered with Mharsul Police Station, Nashik, applicants be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- each with one surety in the like amount.

(C) Applicants shall co-operate with the investigating agency.
