After hearing the matter for some time and when I showed my disinclination to entertain the application, the learned counsel for the applicant seek leave to withdraw the application with liberty to move the Court if the trial do not commence. 2.

It is no doubt true that the applicant is incarcerated since one and half year. However, the pandemic situation cannot guarantee resumption of the trial immediately. Without reserving any liberty, the application is permitted to be withdrawn. 3.

The application is disposed of as withdrawn.
