The Mediator has sent his report. The same is sent in a sealed envelope. The same is opened. A perusal of the report shows that mediation has failed.

Heard learned counsel for the Applicant.

By this Application, the Applicant seeks pre-arrest bail in connection with C. R. No. 517 of 2017 registered with the Kashimira Police Station, Thane (Rural), for the alleged offences punishable under Sections 498A, 406, 377, 323, 504, 506 r/w 34 of the Indian Penal Code.

Perused the papers. According to the Complainant - Priyanka More, wife of the Applicant, the Applicant ill-treated and harassed her. She has further stated that the Applicant was demanding a divorce; that the Applicant was demanding money for AC and LCD; that the Applicant performed unnatural sexual intercourse with her; and that the Applicant was suspecting her character. The allegations as against the Applicant are set out in detail in the FIR. 5.
In the facts, custodial interrogation of the Applicant is not warranted. The Applicant was granted interim protection on 14.12.2017 and he has co-operated with the investigation. Accordingly, the Application is allowed and the interim relief granted to the Applicant is confirmed on the following terms & conditions :-
O R D E R
(i) In the event of arrest, the Applicant be enlarged on bail, on executing P. R. Bond in the sum of Rs. 25,000/- with one or two local sureties in the like amount;
(ii) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
