Learned counsel for applicant submits that the charge sheet is filed against applicant during pendency of this application. Hence, it is prayed that leave may be granted to the applicant to withdraw this application with liberty to prefer a fresh application for bail before the Special Court. Leave granted. Criminal Bail Application No.3087 of 2018 is dismissed as withdrawn with liberty to prefer fresh application for bail before the Special Judge, at Thane. 2.

In the event applicant prefers such an application, the same shall be dealt with by the Special Court in accordance with law and without being influenced by earlier rejection. All contentions on merits are kept open and it is made clear that this Court has not dealt with merits of this application.
