Learned senior counsel for the petitioner submits that the gruesome homicidal death of a young daughter of the petitioner has not been properly investigated and there is no material progress in the matter. He further submits that the statements of witnesses, CC tv footage, CDR all need to be recovered and injuries on the body of the victim also need explanation. 2.
Learned APP upon instructions from the I.O. Mr. Chandanshive who is present in court informs that the accused has been arrested from his residence on the day of incident only. CC tv footage showing entry of the victim and the accused living nilegaonkar 1/2
916-wp-5253.2018.doc with suitcase are also recovered. Statement of the drivers of the cab used by the accused have also been recorded. She also points out the recoveries effected at the instance of the accused. She submits that the material recovered has been forwarded to the forensic laboratory for further investigation. 3.
In these circumstances, considering the fact that the offence has taken place on 15/10/2018, it appears that there is substantial progress in the matter and the Investigating Officer appears to be proceeding further to procure necessary evidence. The contentions of the learned senior counsel as already recorded above, may also be taken into consideration by the I.O. while proceeding further. In the circumstances, we find no case warranting interference by this court. Hence, writ petition is dismissed.
