In this petition, the Petitioners have challenged the Government Notification dated 11 August 2008 issued under section 30(1) of the Maharashtra Regional and Town Planning Act, 1966. The petition is bereft of any grounds of challenge neither there are any contentions on the grounds of delay and laches. What is challenged is resolution dated 16 December 1992 passed by the Satana Municipal Council approved on 11 August 2008. 2.

The learned counsel for the Petitioners accepts the above

skn 2 55-WP-459.2020.doc position and states that a fresh petition with all necessary particulars and grounds would be filed within a period of four weeks. He, therefore, seeks leave to withdraw the petition for that purpose. 3.

We have already vacated the ad-interim order on 6 September 2022 and have also observed that if the Respondentauthorities proceed to take any steps as regards the Petitioners' property, they will follow necessary procedure as per law. 4.

Writ petition is disposed of as withdrawn with liberty as above.
