Learned Counsel for the parties agree that the State of Maharashtra is neither necessary nor proper party to these proceedings. Accordingly, learned Counsel for petitioner seeks deletion of the State of Maharashtra as respondent No.1 from the array of parties. Leave is granted. Necessary deletion to be carried out forthwith.

2] Learned Counsel for parties hand in consent terms which are taken on record and marked "X" for identification. The consent terms bear left thumb impression of petitioner and signature of respondent No.2. Advocates for parties have signed the consent

YBG 50-wp-13416-18 terms and also stated that the same have been interpreted and explained to their respective clients in Hindi. The parties are present in court and they state that they have put their thumb impression and signature on the consent terms, after understanding the full scope and import of the same.

3] Upon examining the consent terms, even I am satisfied that the same are in accordance with law and the settlement arrived at by and between the parties is quite fair and proper. 4] Undertakings given by the respective parties are accepted as undertakings to this Court. In terms of para 7 of the consent terms, the respondent No.2 is at liberty to withdraw the amounts deposited before the trial court with the interest accrued thereon, if any.

5] Petition is accordingly disposed of in terms of consent terms.
