The petitioner seeks release of the vehicle seized as it is more than eight years old and plying within the limits of Greater Mumbai.

Heard learned Counsel for the petitioner and the NEETA SHAILESH SAWANT learned AGP.

Reference is given to the various orders passed by NEETA SHAILESH SAWANT Date: 2023.04.24 11:10:06 +0530 this Court such as order dated September 5, 2013 in Writ

64-WP-5476-2023.doc Petition No. 4963/2013 and order dated October 3, 2012 in Writ Petition No. 9417/2012.

The learned Counsel for the petitioner submits that the petitioner is ready to give an Undertaking that the petitioner would not ply the vehicle within the limits of Municipal Corporation of Greater Mumbai.

Considering the above, we pass the following order :

(i)the petitioner shall file an Undertaking before this Court and also with the concerned RTO that he would not ply the writ vehicle bearing RTO Registration No.-MH-04-FU-9454 within the limits of Greater Mumbai.

(ii)The petitioner shall deposit Rs.25,000/- with the concerned RTO.

(iii)Upon the petitioner giving an Undertaking as directed above and depositing Rs.25,000/-, the concerned RTO shall release petitioner's vehicle bearing Registration No. MH-04-FU-9454.

(iv)The Petitioner shall not ply the said vehicle within the limits of Greater Mumbai.

With the above directions, the Writ Petition stands disposed of.
