1. Heard Mr. Patwardhan, learned Advocate for Petitioners; Mr. Pawar, learned Advocate for Respondent Nos. 1 and 2 and Mr. Ingale, learned Advocate for Respondent Nos. 3 to 9.

2. Perused the record of the case. Admittedly, Revision Application No. 71 of 2022 wherein the order dated 23.11.2022 has been passed is pending before the Joint Charity Commissioner-II, Pune Region, Pune. The impugned order dated 23.11.2022 is an interim order of stay granted until passing of the final order in the said Revision Application. The interest of justice would be served if the Competent Authority is directed by this Court to hear and decide the Revision Application No. 71 of 2022 within a time bound programme.

3. Considering the facts of the present case, the above suggestion was

27.WP.187.23.doc made by this Court to the learned Advocates appearing for the respective parties, hence the following order:- i.The learned Joint Charity Commissioner-II, Pune Region, Pune is requested by this Court to hear and decide the Revision Application No. 71 of 2022 within a period of six weeks from today;

ii. the parties shall appear before the said Competent Authority on 23.02.2023 at 12:00 noon for fixing the schedule of the hearing;

iii. the Competent Authority shall not be influenced by any of the observations and findings given in the impugned order dated 23.11.2022 while deciding the Revision Application No. 71 of 2022;

iv. the parties are at liberty to refer to and rely upon any additional submissions, citations as also written submissions in support of their case;

v. the Competent Authority is directed to pass a reasoned order after hearing all the concerned parties, Needless to state that all contentions of the parties are expressly kept open.
