Heard.

The learned counsel for the Applicant submits that this court by order dated 9.2.2017 directed Applicant to pay sum of Rs.5,000/- per month to the Respondent mother. He submits that he is paying said amount by cheque. He further submits that this court already granted stay not to vacate Mohite 1/2

14 caf99-17.doc the Applicant from the suit premises. He submits that in view of the order dated 9.2.2017, Civil Application be disposed of and First Appeal be taken on board for final hearing.

Considering the submissions made by the learned counsel for the Applicant and the hearing of the Respondent's advocate, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the following order:

a) Civil Application stands dismissed in view of order dated 9.2.2017.

b) Order dated 9.2.2017 passed by this court to continue till the hearing and final disposal of First Appeal.
