This is an Application under Section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.182/2019 registered with Juhu Police Station for offences under Sections 420, 506 of the Indian Penal Code.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsels for the respective parties. 3.

The aforesaid crime was registered pursuant to the first 1/3

information report lodged by Dilip Sitaram Singh. First informant has alleged that the Applicant had taken from him a sum of Rs.5,00,000/- under the pretext that he would get admission for his daughter in Jamnabai Narsi School, Vile Parle. He had stated that the Applicant did not secure admission for the daughter of the first informant. He started avoiding him and refused to pay the money.

The Applicant had stated that he had paid an amount of Rs.4,40,000/- to the first informant and settled the dispute. He has placed on record a copy of the affidavit filed by the complainant. By order dated 20/12/2019, this Court had directed the learned APP to verify the facts from the complainant. Learned APP, under instructions, states that the complainant had received the amount of Rs.4,40,000/- and that he has confirmed the contents of the affidavit. Since it is stated that the dispute is settled, the interim protection granted by this Court (Coram : Sandeep K. Shinde, J.) on 20/12/2019, is confirmed. Hence, the Application is allowed on following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.182/2019 registered with Juhu Police Station, he shall be released on bail on furnishing P.R. bonds in the sum of Rs.25,000/- with 2/3

one or more sureties in the like amount ;

(b) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

The Application stands disposed of.
