1) By a reasoned order dated 4.1.2017 the applicant was granted interim relief.

2) Perused the documents annexed to the application and the record of the investigation. After perusing the first information report it clearly appears that there is prior enmity between the family members of the first informant on one side and the applicant on the other side. It is the allegation against the applicant that on 3.11.2016 the applicant assaulted the first informant and her husband with sharp edged weapon and committed the offence as contemplated under Section 354 of the I.P.C. The medical record of the first informant Smt. Nisha Santosh Karle and her husband Santosh Karale would reveal that the injuries suffered by them were swelling and abrasion and caused

2 /2ABA-2223-16-10 with hard and blunt object. Prima facie, it appears that the version narrated by the applicant in FIR is an exaggerated version. It is also stated in the FIR that there are always recurring quarrels between the parties. In view of the above, the applicant has made out a case for his release on pre-arrest bail.

3) Hence, the following order.

4) The interim relief granted by an order 4.1.2017 is hereby confirmed however, the applicant is directed to attend the Investigation Officer as and when called for between 11.00 a.m. to 2.00 p.m. and to join the process of investigation till the submission of the charge sheet. It is needless to mention that before calling the applicant in police station the Investigation Officer shall issue notice u/s. 160 of the Cr.P.C. thereby stating the date and time.
