Heard learned counsel for the applicant and the learned APP for the State. The Investigation Ofocer is present. The charge-sheet is filed.

In this view of the matter, learned counsel for the applicant seeks leave to withdraw the application with liberty to approach the Sessions Court for bail. If such an application is filed, the Sessions Court shall consider it on its own merits.

It is contended that the applicant's wife is pregnant and about to deliver a child. A request is made for 1/2

The application is allowed to be withdrawn with liberty as prayed for.

It is made clear that I have not made any observations on the merits of the matter.
