This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 756 of 2021 registered at Chakan Police Station, Pimpri-Chinchwad for the offences punishable under Sections 395, 427, 506(2), 120-B of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The allegations against the applicant and other co-accused are of committing decoity.

The bail is sought on the ground of parity. In support of the said ground, the learned Counsel for the applicant has placed on record copy of the order dated 10 March 2022 passed by the Additional Sessions Judge below Exhibit 49 in Sessions Case No.171 of 2021. By the said order, the Sessions Court has released the co-accused Rahul Kshirsagar on bail.

I have perused the charge-sheet. The role attributed to the present applicant and co-accused Rahul Kshirsagar appears to be identical. In that view of the matter, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Ratan Mahadev Danane be released on bail in Crime No. 756 of 2021 registered at Chakan Police Station, PimpriChinchwad for the offences punishable under Sections 395, 427, 506(2), 120-B of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the police station once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.

(iv) The applicant shall furnish his residential address and mobile number to the concerned police station.
