Mr. Ingale, learned counsel for the Applicant, seeks leave to withdraw this application for condonation of delay and also the Appeal, in view of the settlement arrived at between the parties on 13th June 2018.

Accordingly, the delay is condoned. The Appeal, along with Civil Application thereto, is allowed to be withdrawn and stands disposed off as such.

Issue 'Court Fee Refund Certificate', as per the rules. Appellant is also permitted to withdraw the amount of Rs.25,000/- i.e. the statutory deposit made in the Court.
