This is an application seeking leave to appeal thereby challenging the judgment and order passed by the Learned Metropolitan Magistrate, 4th Court in CC No. 2585/SW/2003 thereby acquitting the respondent No.2 of the offence punishable under Section 420 of the Indian Penal Code. There is a delay of 18 days in filing the appeal.

For the reasons assigned in paragraph Nos. 4 and 5 of the application, the delay of 18 days needs to be condoned in the interest of justice.
