2) After arguing for some time, the learned Counsel for the applicant seeks leave to withdraw the application. 3) The learned Counsel, however, submits that as the applicant has been in custody for more than 6 years and only 3 witnesses have been examined, the trial be expedited. 4) The submission, in the backdrop of the period of incarceration, appears justifiable.

50-BA-3764-23.DOC 5) The learned Additional Sessions Judge seized with Sessions Case No. 217 of 2018, arising out of CR No 675 of 2017, registered with Santacruz Police Station, is requested to make an endeavour to commence and conclude the trial in Sessions Case No. 217 of 2018 as expeditiously as possible and preferably within a period of six months from the date of the communication of this order.

6) The learned Counsel for the applicant further seeks liberty to revive the prayer for bail in the event the trial is not concluded within the said period.

7) The application stands dismissed as withdrawn with liberty as prayed for.
