At the outset, learned APP submitted that the trial has commenced and that so far the Complainant has been examined and presently the victim is in the witness box. Learned APP states that about 6-7 more witnesses are yet to be examined. 2.

Considering the fact that the trial has commenced, it is not necessary to consider this Application at this stage. Accordingly, learned counsel for the Applicant seeks leave to withdraw this Application. Accordingly, the Application is disposed of as withdrawn.

Since the trial has commenced, learned trial Judge to conclude the trial as expeditiously as possible and in any event before 31.12.2019.
