Heard the learned counsels for the respective parties. 2.

By this application, the applicant has sought to withdraw the amount deposited by the appellant / insurance company before the MACT, Mumbai.

By judgment and award dated 17/06/2014 passed by the Member, MACT, Mumbai in Application No.1887 of 2008, the Tribunal has awarded compensation of Rs.4,45,089/- with interest @ 1/2

P.H. Jayani 08(III) CAF4411.18.doc 6% per annum to the respondents herein from the date of filing of petition till realization of the amount.

The challenge of the respondent /insurance company is restricted to the quantum of the compensation awarded by the Tribunal. Having considered the grounds raised in the appeal, 50% of the total compensation deposited by the insurance company alongwith proportionate interest accrued thereon is ordered to be paid to the applicant - Bharat Damodar Satwe. The Tribunal to invest the balance amount in any nationalized bank till the disposal of the appeal. 5.

It is made clear that the payment is subject to the final outcome of the appeal. The applicant shall give an undertaking before the Tribunal that he shall abide by the order that may be passed in the appeal.
