The affidavit-in-reply has been presented by the Additional Tahasildar-cum-ALT,Hatkanangale, Dist.Kolhapur and in paragraph -8 of the reply it is recorded thus: "8.
I say that, due to lesser availability of the field and also due to administrative change overs, and working occupancies, the case of the Petitioners and alike remained pending. However; as on today the overview of the land availability is taken and it is ascertained that, deducting the land portion already allocated, the land accumulation of admeasuring 11 H.84R from Collector Pool is available for distribution of lands to the Petitioner and alike. I say that, taking into consideration, the above stated position as regards the availability of land, the notices are also caused to be issued to the concerns, intending, completing of essential formalities towards distribution of lands in accordance with law. I say and submits that, as per the notices, the hearing of all the Borey 1/2
spb/ 44wp360-19.odt concerned parties is scheduled on 03.05.2019. I submit that, to complete the entire process uptill the end point of handing over the physical possession of the lands would take period of maximum 6 months from today. I say that, every possible endeavor shall be taken to complete the entire land distribution task to the Petitioner and alike within the afore-stated period. At the cost of repetition, I tender my unconditional apology for the inordinate delay which is being noticeably occurred in implementing the order dated 04th October, 1986 passed by this Hon'ble Court in WP No. 2935 of 1984." In view of the undertaking recorded in the above referred paragraph, the grievance of the Petitioner raised in the instant petition shall stands redressed.
Writ petition is disposed of with direction to the Respondents to complete the process of distribution of lands within a period of six months from today.
