The petition is filed for seeking directions to respondent No.2 to direct his officers to delete the entries of reservation for the project affected persons from the other rights column of the 7/12 extract of the land bearing gat No.249/1 admeasuring 22R, situated at Mouje Hinjwadi, Taluka Mulshi, District Pune.

Mr. Sawant, learned AGP, on instructions, makes a statement that though notification under Section 4 of the Land Acquisition Act, Shubhada S Kadam 1/2

903 wp 14040.17.doc 1984 was issued on 3rd December, 1982, the award under Section 12 of the said Act never came to be passed. Even otherwise, the acquisition has lapsed.

In the above circumstances, we find that there is no impediment in allowing this petition in terms of prayer clause (b). We, accordingly, direct the respondent No.2 to direct his officers to delete the entries of reservation for the project affected persons from the other rights column of the 7/12 extract of the land belonging to the petitioners and bearing gat No.249/1 admeasuring 22R, situated at Mouje Hinjwadi, Taluka Mulshi, District Pune .

The writ petition stands disposed of.
