The only point urged by the learned Counsel for the petitioner/accused No.1 is to the effect that the trial of offence alleged against him is pending before the learned trial Court from the year 2010 and, therefore, it needs to be expedited. Gaikwad RD 1/2

The petitioner/accused No.1 so also the accused No.2 who happens to be his wife are conspicuous by their absence before the learned trial Court. Be that as it may, careful perusal of the record does not show that the petitioner/accused has ever made an application for expeditious trial before the learned trial Court. In this view of the matter, the petition is disposed of with following Order.

ORDER

(i) The Petitioner is permitted to make an application for expeditious disposal of the trial before the learned trial Magistrate and if such an application is filed, then the learned trial Magistrate should deal with the same according to the provisions of law.

(ii)The Petition is accordingly disposed of.
