This is an application for anticipatory bail in connection with C.R.No. 383 of 2018, registered with Mira Road Police Station. Prosecution case is that the victim aged about 24 years was in relationship with accused no.1 since 2013. First Information Report ("FIR", for short) was lodged for the offences punishable under Sections 376, 313, 354, 323, 504 and 506 of Indian Penal Code ("IPC", for short), on 11th November, 2018. As far as the applicant is concerned, it is alleged that somewhere in 2013, the applicant who is friend of accused no.2 had approached
rpa 2/3 918-aba-2452-18.doc the complainant and outraged her modesty. However, no complaint was lodged till 2018 against the applicant. It is not alleged that the applicant was involved in physical relationship with the complainant.
Taking into consideration the role attributed to the applicant and the fact that the complaint was lodged in 2018, attributing overtact to the applicant in respect to the incident of 2013, case for grant of anticipatory bail is made out. Hence, I pass the following order:
:: O R D E R ::
(i) Anticipatory Bail Application No.2452 of 2018, is allowed;
(ii) In the event of arrest of the applicant in connection with C.R.No. 383 of 2018, registered with Mira Road Police Station, he be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;

(iv) Anticipatory Bail Application No.2452 of 2018, stands disposed of;
