This is an application seeking protection under Section 438 of Code of Criminal Procedure, for a temporary period with a view to approach the appropriate Court for seeking appropriate reliefs. Learned counsel for the applicants submitted that the applicants are residents of Mumbai. The complaint has been lodged by the wife of applicant no.1, vide C.R.No.602 of 2018, with Nayapura Police Station, Kota city, State-Rajasthan, alleging offences punishable under Sections 420, 467, 468, 471 of
rpa 2/3 917-aba-2453-18.doc Indian Penal Code ("IPC", for short), which arises out of matrimonial dispute. Applicant no.2 is the brother of applicant no.1. In the circumstances, relief as prayed for, can be granted for a temporary period.
Hence, I pass the following order:
:: O R D E R ::
(i) Anticipatory Bail Application No.2453 of 2018, is allowed;
(ii) In the event of arrest of the applicants in connection with C.R.No.602 of 2018, registered with Nayapura Police Station, Kota city, State-Rajasthan, they be released on bail on their furnishing P.R. Bond in the sum of Rs.20,000/-, each, with one or more sureties in the like amount;
(iii) This protection is granted for a period of six weeks to enable the applicants to approach appropriate Court for appropriate reliefs;
