This is the second application for bail by the applicant. The earlier application preferred by the applicant was dismissed as withdrawn by this Court by its order dated 18.4.2017.

The record indicates that, by subsequent Order dated 10.7.0217, the co-ordinate Bench of this Court was pleased to release the co-accused Annasaheb B. Gholave @ Balu by its Order dated 10.7.2017. The role attributed to the said co-accused namely Annasaheb @ Balu is more serious in nature than the present applicant.

After perusing the record, it appears to this Court Page-1/2
1-ba-2956-17 that, the role attributed to the present applicant is much lessor than the co-accused Shri. Annasaheb B.Gholave @ Balu and therefore, the present applicant is entitled to be released on bail on the ground of parity.
Hence, the following order.
a) The applicant is directed to be released on bail in connection with CR No.45 of 2016 registered with Dindoshi Police Station, Mumbai, on his furnishing PR bond in the sum of Rs.30,000/- with one or more sureties in the like amount.
b) The applicant is directed to report the Investigating officer of Dindoshi Police Station, Mumbai once in a month on every first Saturday between 11.00 a.m. to 1.00p.m. till further orders.
c) The applicant shall not tamper with the evidence. d) The applicant should attend the Trial Court on the date of hearing.
