By this Criminal Application, the applicant seeks permission for renewal of the passport for a period of 10 years. 2.

The learned counsel for the applicant submits that respondent No.2 - passport authority is not ready to renew the passport unless there is an order of this Court. He prays that the passport of the applicant be renewed for a period of 10 years.

On query, the learned counsel for respondent No.1 submits that there is no other criminal record of the applicant except conviction in this one matter. She further submits that once the person is convicted or if any, criminal case is pending against him/her, the order and permission of the Court is required for renewal of the passport. 4.

The applicant is convicted for the offence punishable under section 323 read with 34 of the Indian Penal Code. As per information given by the learned APP that the applicant does not have any criminal record, the passport authority may consider to renew the passport of the applicant in accordance with the rules, however, it may be extended for a period of 3 years.
