1] This is an application under section 439 of Cr. P.C for bail in CR No.230 of 2018 dated 7.3.2018 dated registered with Tulinj Police Station, District Palghar under sections 302, 365, 364, 201, 120-B read with 34 of the Indian Penal Code.

2] Heard the learned counsel for the applicant and the learned APP. Perused the record.

3] The learned counsel for the applicant submitted that, the co-accused Raj G. Jadhav who has been attributed with same and/or similar role has been released on bail by this Court by its Order dated 7th December 2018 and therefore the applicant may be released on bail on the ground of parity. 1/2

BA.3136-2018.doc 4] Perusal of charagesheet would indicate that, there is substance in the contention of the learned counsel for the applicant. In Order dated 7th December 2018, while releasing the co-accused Raj G. Jadhav on bail, the statements of witnesses namely Sudhiraj Chavan and Khageshwar Chetri have been considered. The applicant herein has played same and/or similar role as that of Raj Jadhav and therefore the applicant herein is entitled to be released on bail on ground of parity.

5] Hence the following Order:- i] Applicant is directed to be released on bail in connection with C.R. No.230 of 2018 registered with Tulinj Police Station on his furnishing PR bond in the sum of rs.25,000/-with one or more solvent local sureties in the like amount. ii] Applicant shall report to the concerned Police Station on first Friday of every month between 10-00 a.m to 12.00 noon. iii] Applicant shall attend the Trial Court on the date of hearing regularly, unless exempted by the Court.

iv] Applicant shall not tamper with the evidence and/or influence prosecution witnesses.
