P.C.:- By an Order dated 23rd January 2018, on the basis of the statement made by the Applicant that he will deposit the amount involved in the present crime i.e. Rs.6,00,000/- within a period of four weeks from 23rd January, 2018, the Applicant was granted interim relief.
The Applicant deposited an amount of Rs.3,00,000/- in the Registry of this Court though not within the stipulated period as mentioned in order dated 23rd January 2018. The record further indicates that the Applicant filed an Application bearing No. 174 of 2018 for extension of time to deposit the balance amount of 1/2
ssm 2 19-aba2197.17.sxw Rs.3,00,000/- and this Court, by an Order dated 23rd February, 2018 extended the said period till 9th March, 2018, as a last chance. The note put up by the Registry indicates that, despite extension granted to the the Applicant, the Applicant has failed to deposit the balance amount in the Registry of this Court till today. It is thus, clear that the Applicant has committed breach of his own statement and has failed to comply with the Order dated 23rd February, 2018 passed by this Court in Criminal Application No. 174 of 2018.
In view of the above, the Applicant is not deserve for further extension of time and sympathy.
Interim relief granted by this Court on 23rd January, 2018 is hereby vacated. As a consequence thereof, the Application is dismissed.
