Perused the prayer in the petition which reads thus: "1) --------- 2) --------- 3) The Hon'ble High Court may pass writ of mandamus or writ of certiory and to appoint enquiry officer and to conduct the enquiry of election officer and caretaker i.e. respondent no. 2 Mr. Chandrakant Appasaheb Patil, who is retired from the service as a Supdt. and report be called for and to set

2 20.2466.19 wp.doc aside proceeding conducted by the election officer in respect of the matter of Lee Sophiya Education Trust i.e. registration no. F-2556 (Pune).

4) The Hon'ble High Court may pass an order and appropriate order be passed in respect of proceeding conducted by the election officer Mr. C.A. Patil in the matter of Lee Sophiya Education Trust, Registration no. F-2556(Pune) after appointment of new election officer in the matter of application no. 26 of 2011 dtd. 6/7/2012 and appropriate order be passed in this matter.

5) The Hon'ble court may pass an order and new Administrator be appointed for Lee Sophiya Education trust and to conduct elections amongst the old members of the trust or appropriate order be passed to enroll new members for the said trust.

6) -------- Admittedly, Change Report proceedings under Section 22 of the Maharashtra Public Trust Act are pending adjudication before Asstt. Charity Commissioner. That being so, in my opinion, petition is not maintainable. Petition stands dismissed. [NITIN W. SAMBRE, J.]
