P.C.:- This is an Application under Section 439 of the Code of Criminal Procedure for bail in CR No. 182 of 2017 dated 20th May, 2017 registered with Kurla Police Station, Mumbai , re-numbered as CR No. 20 of 2017 dated 20th May, 2017, registered with DCB, CID, Unit-5, under Sections 465, 467, 471, 468 of the Indian Penal Code read with Section 3, 25 of the Indian Arms Act. Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record annexed to the Application. The prosecution case in brief is that, the sleuths from Crime Branch received confidential information from reliable 1/3

ssm 2 informant that a person by name Kumar will be arriving at Kurla (West), with a fire arm. Accordingly, a trap was laid by the Crime Branch. The informant pointed out a person by name Kumar. The police thereafter, accosted the said person who told his name as Kumar Shankar Dongre. During his search, a country-made pistol and one live cartridge was found. During his search a license having name as 'Kumar Shankar Dongre' Ambejogai, District Beed but, with a different photo of a history sheeter on the police record namely 'Sanju Sunka Dongre' i.e. the Applicant was found.

The police arrested Applicant immediately i.e. on 20th May, 2017. During the course of the investigation, it was revealed that, the Applicant with a view to shield himself from the clutches of law, as he is involved in eight other cases in different parts of Maharashtra has manufactured bogus documents in the name of Kumar Shankar Dongre, such as license and has also procured a SIM card from the Reliance Company by submitting the said documents. After completion of investigation, the police have submitted charge-sheet. The Investigating Officer Smt. Surekha Jaunjal has filed an affidavit dated 10th April, 2018, stating that the Applicant is an accused in eight other crimes registered at different districts in the 2/3

ssm 3 State of Maharashtra. Out of the said eight crimes, one crime is registered at Pungama Police Station, Surat at Gujarat under Section 379, 380 read with 34 of the Indian Penal Code. It further appears from the record that, the Applicant is on bail in the said crime. Thus, it is clear that the Applicant with a view to shield himself from the clutches of law, has changed his identity from 'Sanju Sunka Dongre' to 'Kumar Shankar Dongre' and has procured various documents from the Government Authorities by submitting false information and/or forged documents. There are antecedents at the discredit of the Applicant. The Applicant was also found in possession of a illegal fire arm.

In view thereof, this Court is of the considered view that, the Applicant is not entitled to be released on bail. Application is accordingly rejected.
