This is an application for condonation of delay, for setting aside abatement and for bringing legal representatives of deceased respondent No.4, on record, out of which, the respondent No.4C Mrs. Gopika Dnyaneshwar Bhorapkar has already been brought on record way back in the year 2005.

In that view of the matter, there is no abatement as one of the legal representatives is already on record.

On hearing the learned counsel for the applicants and the learned counsel appearing for the respondent Nos.4A and 4B and for the reasons mentioned in the application, the same is allowed in terms of prayer clause (A), (B) and (C). The civil application is disposed of.
