Heard learned counsel for the parties.

After hearing for some time, the parties have filed Minutes of Order dated 11th January, 2019 duly signed by their respective advocates. The same is taken on record and marked "X" for identification. The Minutes of Order is accepted. It reads thus:

Minutes of Order "1.

By consent, the order dated 22nd December, 2017 and the order dated 26th September, 2018 passed by Judge Shri A.K. Yawalkar is set aside and the Petitioner is permitted to file affidavit of Mr. Kamlesh Pal as his second witness. Such affidavit shall be affirmed and filed on or before 14th January, 2019 and a copy of such affidavit will be served on the advocate of the Respondent. The Petitioner states Vishal Parekar 1/2

The Petitioner is permitted to make necessary application for taking additional documents on record which would be decided by the trial Court on its own merits. Contentions of both the parties are kept open. 3.

The Respondent shall be at liberty to lead evidence if required, after the evidence of second witness of the Petitioner is recorded.

The Petition disposed of in terms aforesaid, with no order as to costs"

The Writ Petition is disposed of in terms of Minutes of Order.
