By an Order dated 19.12.2017 while granting interim relief, the Applicant was directed to attend Investigating Officer on stipulated dates and to join the process of the investigation.
The learned APP on instructions from the Investigating Officer submitted that the Applicant never attended the Investigating Officer and simplicity got endorsement of attendance in his diary from the Station House Officer. The learned Counsel for the Applicant tendered one diary across the bar thereby indicating that the Applicant attended the Police Station and the Station House Officer has given an endorsement to that effect. Thus, it is true that the Applicant did not attend the Investigating Officer and participated in the process of investigation.
