Learned APP submits that in the present case i.e. Sessions Case No. 1 of 2015, the trial has commenced and the prosecution has examined one witness. In view o this, it would not be appropriate to consider an application under section 439 of the Code Criminal Procedure, 1973. Hence, the learned Counsel for the applicant fairly submits that he would withdraw the application. Liberty as prayed for is granted in the interest of justice. It is made clear that the application is not heard on merits. The application stands dismissed as withdrawn and disposed of accordingly.
