Heard learned counsel for the applicants and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 498-A, 306, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860 in connection with FIR No.I-910 of 2022 dated 1/3

25/11/2022 registered with Manpada Police Station, Thane. 3.

The marriage of Priya with Kunal Sanjay Koli was solemnized on 27/01/2022. It is alleged by the complainant i.e. father of the deceased-Priya that her in-laws including applicant-Sangeeta Sanjeev Koli, who is mother-in-law and applicant-Tejal Hemant Patil, who is sister-in-law of the deceased-Priya were harassing her. Priya committed suicide. Priya's husband has been arrested and he is in custody. The allegations in the FIR appear to be general in nature. The applicants have co-operated with the investigation and learned APP on instructions of the Investigating Officer, who is present in the Court, submits that the custodial interrogation of the applicants in the present case is not required. In my opinion the Investigating Officer is justified in taking a position that the custodial interrogation is not required.

In this view of the matter, the applicants can be released on anticipatory bail. Hence, the following order :-

O R D E R

(a) Applications are allowed.

(b) In the event of arrest in connection with FIR No.I-910 of 2022 registered with Manpada Police Station, Thane, the applicants-Sangeeta Sanjeev Koli and Tejal Hemant Patil shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- each with one or more sureties in the like amount. (c) The applicant-Sangeeta Sanjeev Koli shall report to the concerned police station on 04/02/2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called.

(d) The applicants to co-operate with the Investigating Officer.

(e) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence. (f) The applicants shall furnish the details of their residential addresses and phone numbers to the investigating officer.
