Heard learned counsel for the applicant and learned APPs for the State. Investigating Officer is present. 2.

The offence alleged against the applicant is registered vide C.R.No.42/2022 and C.R.No.40/2022 with Economic Offences Wing, Mumbai, punishable under Sections 406, 420, 477(A), 120-B of the Indian Penal Code read with Sections 447 and 448 of the Companies Act, 2013. 3.

Learned APP, on instructions, pointed out that a notice under Section 41A of the Code of Criminal Procedure 1/2

916. ABA 3606-22.doc (hereafter 'Cr.P.C.' for short) has already been issued to the applicant. The investigating officer expects the applicant to co-operate.

Learned counsel for the applicant submits that the applicant is ready and willing to co-operate and would attend such dates as may be specified by this Court and the investigating officer.

In this view of the matter, the applicant to report to the investigating officer on 5th, 6th and 7th January, 2023, between 11.00 a.m. and 1.00 p.m. and thereafter as and when called.

A statement is made by learned APP, on instructions of the investigating officer, that in case the investigating officer feels at a later stage that arrest of the applicant is necessary, he will issue a 72 hours notice. Liberty to the applicant to apply afresh is kept open.

The applications are disposed of.
