This is an application under Section 438 Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No. 655 of 2021 registered with Chembur Police Station for offences under Section 381 of the Indian Penal Code.

Heard learned Counsel for the Applicant learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties . 3.
The aforesaid crime was registered pursuant to the FIR lodged by Smt. Smitra Vijay Matreja. The FIR prima facie reveals that the Complainant had contacted K.K.Maid Services , Chembur, as she was in need of household help. The said agency had sent the Applicant to the house of the Complainant. The Complainant has staed that on Digitally signed by PRASANNA P SALGAONKAR Date:
2023.03.18 15:23:12 +0530 27.11.2021, she had told the Applicant to do the household work. Later PRASANNA P SALGAONKAR
she received a phone call from her neighbor that the maid was not in the house. She made a video call and she saw that all her belongings were scattered all over the house. The Complainant realized that sum of Rs.8000/- as well as ear rings of her daughter worth Rs.6500/- were missing. She therefore lodged the FIR for committing theft of Rs.8000/- as well as gold ear rings worth Rs.6500/-. 4.
In the course of hearing, learned Counsel for the Applicant, under instructions, states that the Applicant is ready to pay to the Complainant an amount of Rs.14,500/- , and states that the amount will be deposited in the account of the complainant within four days from the date of this Order. The Complainant who is present before the Court states that she is ready to settle the matter and will give no objection for compounding the offence. Statements made by the Applicant as well as the Complainant are accepted as undertaking to the Court. The Investigating Officer who is present before the Court states that in view of the settlement between the parties an endeavor will be made to file the chargesheet as soon as possible as to enable the parties to compound the case.

Considering the fact that both the parties have arrived at settlement, in my considered view this would be a fit case for grant of pre-arrest bail. Hence the order:- (i) In the event of arrest of the Applicant in Crime No. 55 of 2021 registered with Chembur Police Station, the Applicant be released on
bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with one or two sureties in the like amount, to the satisfaction of the Investigation Officer.
(ii) The Applicant is put to notice that in the event the Applicant fails to deposit the amount of Rs.14,500/- within four days, the bail order shall stand recalled without further reference to the Court. (iii) Applicant shall report to the Investigating Officer as and when required by the Investigating Officer.
(iii) Applicant shall keep the Investigating Officer informed of her current address and mobile/contact detail, and/or change of residence or mobile/contact detail from time to time.
