Heard Shri. Ajay Basutkar, the learned counsel for the Petitioner.

By this Writ Petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 04/11/2017 passed by 7th Jt. Civil Judge Senior Divison, Pune below Exhibit 294 in Special Civil Suit no. 929 of 1999 allowing the Respondent's

2 30.1971.18 wp.doc application for amendment of the Plaint by adding flat property in paragraph 1 of the Plaint.

After arguing for sometime, the learned counsel for the Petitioner submits that the Petitioner may be permitted to withdraw the present Writ Petition unconditionally. He submits that hearing of the Special Civil Suit is of 1999 be expedited. To that effect, he has given in writing. Same is taken on record and marked as 'X' for identification. Same is accepted. Hence, following order. (a) The Writ Petition is disposed of as withdrawn. (b) Hearing of the Special Civil Suit No. 929 of 1999 pending before 7th Jt. Civil Judge Senior Division, Pune is expedited. (c) No order as to costs.
