It is trite that the abatement has to be strictly construed and the application for setting aside abatement has to be liberally construed.

For the reasons stated in the application, Civil Application is allowed in terms of prayer clause (b) and (c). Necessary amendment be carried out in the petition. 5.

Civil Application stands disposed of.

Place the present Writ Petitions along with Writ Petition No.616 of 2022 as per the earlier order passed by the court on 20.01.2022 in Writ Petition No.616 of 2022 on 13.04.2022.
