This is an Application for modification of Clause No.8(i) of Order dated 6th December, 2022, passed in Criminal Appeal No.789 of 2021.

By the said Order, this Court had directed that, the Appellant/Applicant be released on bail on his executing P.R. bond in the sum of Rs.25,000/- with one or two separate solvent local sureties in the like amount (Underline emphasis supplied).

Learned Advocate for Applicant submitted that, Applicant is unable to provide local sureties, however he is willing to provide sureties from District Thane. She submitted that, as the Applicant is unable to 1/2

BGA 12-Ia-4474-2022.odt comply with the said condition, he is still languishing in jail despite bail Order granted in his favour.

In view of the above, we are inclined to modify the said condition.

The condition No.8(i) is accordingly modified and the Applicant is permitted to furnish one or two sureties from District Thane. The Applicant is further directed to submit documents of the sureties before the Trial Court so also before the Investigating Agency before his actual release from jail.
