The learned Counsel for the respondent, on instructions from the respondent who is present in Court, makes a statement that the respondent shall withdraw the Hindu Marriage Petition No. 321 of 2017 filed by him for

Rane 2/2 MCA-225-2018 (SR. 11) Monday, 11.2.2019 restitution of conjugal rights in the Court of Civil Judge Senior Division, Kalyan within a period of three weeks from today. The statement is accepted.

In view of this statement, the present Miscellaneous Civil Application is rendered infructous. The same is accordingly disposed of.

It is made clear that, if the respondent does not withdraw the proceedings being Hindu Marriage Petition No. 321 of 2017, the applicant is at liberty to seek revival of the present Miscellaneous Civil Application.
