In view of the reasons stated in paragraph Nos. 4 and 5 of the application, the delay occurred to bring the legal representatives of deceased Appellant No.9 is condoned. The order, abating the appeal against deceased Appellant is set aside. Application is allowed and made absolute in terms of prayer clauses (a) and (b). Consequential amendments shall be carried out within three weeks from today (in First Appeal 2389/2006) . Application is allowed and disposed of in the aforesaid terms. (Sandeep K. Shinde, J.)
