Pursuant to the praecipe filed by the learned counsel for the Appellant, the matter is taken on production board. 2.

Heard the learned counsel Mr. Diwan for the appellant. 3.

Learned counsel for the appellant submits that he received instructions from his client to withdraw the First Appeal unconditional. 4.

To that effect, he has given in writing, the same is taken on record and marked as "X" for identification. The same is accepted. 5.

Learned counsel for the appellant submits that at the time of 1 / 2

507.FA496_2019.doc filing of First Appeal, the appellant deposited an amount of Rs.25,000/- in the registry of the Court. He submits that in view of the withdrawal of First Appeal, the Appellant may be permitted to withdraw the said amount unconditionally.

The Appellant is permitted to withdraw sum of Rs.25,000/- deposited by them at the time of filing of First Appeal in the registry with accrued interest, if any without furnishing any security. 7.
