The above Interim Application is filed seeking the following reliefs:- a) That this Hon'ble Court be pleased to quash and set aside the judgment dated 11/11/2022 passed in M. J. Petition No.A-1662 of 2022 and grant divorce to the appellant.

b) That pending the hearing and final disposal of the appeal this Hon'ble Court be pleased to direct the respondent to join and stay with the Appellant in the matrimonial home or wherever he wants to reside with me and continue the married life.

13.IA.2298.23.DOC c) The Appellant Streedhan is also in custody of Respondent and his family members and still the Appellant wants to save the marriage and wants to stay with Respondent and his family. The Appellant also prays that pending the hearing and final disposal of the appeal this Hon'ble Court be pleased to direct the respondent and his family members to keep the Streedhan in safe custody."

The learned counsel appearing on behalf of the Appellant/Applicant submitted that the Respondent-husband has already remarried as per the affidavit filed by him dated 18th August, 2023. He, therefore, submitted that the above Interim Application is rendered infructuous.

In these circumstances, the above Interim Application is disposed of as infructuous. No order as to costs. This order will be digitally signed by the Private Secretary/ Personal Assistant of this Court. All concerned will act order.
