Heard the learned counsel for the applicant and the learned APP for the State.

This Court had initially granted pre-arrest bail by an order dated 13th April, 2023. On 25th September, 2023 the learned counsel for the applicant sought leave to withdraw the application on the ground that the applicant was not in a position to make such deposit and the Court was informed that the applicant in a written communication expressed his desire to surrender. On the basis of the said statement, the order of pre-arrest bail dated 13th April, 2023 stood recalled.

Now the applicant is stated to be in a position to make the deposit.

Since the order dated 13th April, 2023 was recalled on the basis of the statement which was made on behalf of the applicant that too on the strength of a written communication made by the applicant, there is no propriety in entertaining the application as the applicant then desired to surrender.

The learned APP on the instructions of the investigating officer states that the applicant has made himself scarce. 6.

In the circumstances, I am not inclined to entertain this application.

Application stands rejected.
