At the outset, learned APP on the instructions states that the trial has commenced and nine witnesses have been examined till date. He submits that in all prosecution intends to examine 40 witnesses i. e. about 30 more witnesses.

Considering the aforesaid, it is not necessary to consider the present Application on merits, since the trial has commenced. Accordingly, the Application is disposed of.

Since the trial has commenced and nine witnesses have been examined till date, the learned Judge shall decide the case as
BA 3001-17.doc expeditiously as possible and preferably within 12 months from the date of receipt of this order.

It is made clear, that this Application has not been heard on merits and the learned Judge shall conduct the case on its own merits. (REVATI MOHITE DERE, J.)
